Basis of Sale

These Terms and Conditions constitute the entire relationship for the sale of goods between Easy Flame and the customer. Read and understand these terms before placing an order.

Samples, drawings, descriptions, or advertising on this site are for approximation only and do not form part of the contract. Promotional pricing is superseded by the pricing on the site and in your order confirmation.

You place an order and enter a binding contract when you accept the Terms and Conditions on the website and make payment for the goods. An order number will be issued upon completion.

Goods are automatically consigned for delivery upon order placement. To cancel an order, do so before 4 pm on the order day to avoid return costs. Returned goods, meeting specified conditions, will be refunded, excluding transport costs.

We reserve the right to revise and amend these Terms and Conditions. You are bound by the terms active at the time of order placement.

Right to Cancel

You have the right to cancel this contract within 14 days without giving a reason. The cancellation period expires 14 days from the date of the final item delivery in your order.

Effects of Cancellation

If you cancel, we will reimburse all payments received from you. If you are unable or unwilling to arrange return, or if goods suffer a material reduction in value due to your handling, we’ll reduce your reimbursement accordingly.

Once dispatched, you’re responsible for return costs. If Easy Flame arranges return:

– £60 inc VAT per pallet for areas with included delivery costs.

– £40 inc VAT + surcharge value per pallet for areas with delivery surcharge.

Reimbursement will be prompt, within 14 days of goods return. Refund method matches your initial payment, with no fees.

VAT

Ensure correct VAT rate application on domestic solid fuel. Baltic Logs LTD  isn’t responsible for incorrect VAT application. Full details in HMRC Reference: Notice 701/19 (August 2010).

– Fuel for domestic use: 5% VAT.

– Other supplies: Standard rate of VAT.

By agreeing to terms, you certify compliance with legislation.

The Goods

Goods should:

– Conform to the ordered specification.

– Be free from material defects.

– Comply with all applicable statutory and regulatory requirements.

Does not apply to wear and tear, damage, or negligence.

We take reasonable steps for delivery in good condition. Store goods appropriately, especially fuel.

Delivery

The contract is fulfilled on delivery in good condition. If not, it’s fulfilled upon your refund receipt for notified damages.

Goods are considered delivered in a fit state if you sign the delivery note confirming safe delivery. We advise against unattended deliveries.

Damage during delivery:

– Sign delivery note with damages.

– Notify us within 24hrs and provide evidence.

– Refund for lost/unusable products.

Delivery timeframes are guidelines. Orders received by 4 pm on a working day are dispatched the same day. Ensure access and accurate delivery instructions.

Delivery Access

Ensure suitable access to the delivery location. If delivery fails due to anticipated access issues, a £35 inc VAT per pallet redelivery fee may apply.

It’s your responsibility to provide the correct address and instructions. If vague, a redelivery fee may apply.

If not at home during the delivery of a communicated specific day, a redelivery fee may apply.

Damage to Property during Delivery

Easy Flame disclaims liability for damage to property or persons during delivery. Liability lies with the 3rd party haulier.

In case of damage:

– Obtain a written acknowledgement from the driver.

– Take photographs.

– Inform Easy Flame.

Defective Goods and Returns

It’s your responsibility to ensure the goods are suitable for their intended use. In the unlikely event of non-conformity, please inform us. We’ll either remove and refund the goods or replace them at our cost.

If you’re dissatisfied with conforming goods and want to return them:

– The goods must be returned in a saleable condition.

– At least 66% of the original order must be returned.

We’ll collect the goods and provide a refund, deducting £40 inc VAT per pallet for transport costs (and shipping surcharges if applicable).

These terms apply to any replacement goods sent.

If returning goods, ensure our haulier has adequate access. Additional haulage costs due to insufficient access will be passed on to you.

Limitation of Liability

If either party fails to comply with these terms, neither party is responsible for losses, except for foreseeable consequences of the failure to comply. This limitation doesn’t affect liability for:

– Death or personal injury caused by negligence.

– Fraud or fraudulent misrepresentation.

– Breach of implied obligations under Sale of Goods Act 1979 or Supply of Goods and Services Act 1982.

– Losses prohibited by Consumer Protection Act 1987.

We won’t be liable for consequential or indirect losses, or losses/damages during delivery, the responsibility for which lies with our contracted haulier.

Force Majeure

We’re not responsible for failure due to Force Majeure events, such as strikes, natural disasters, or communication failures. Our obligations are suspended during these events, and we’ll strive to fulfill them once the event ends.

Assignment

You can’t assign or transfer your rights or obligations under these terms without written consent from Easy Flame.

Purchasing Compliance

Certify that the delivery address allows the sale and use of purchased products, following all local and national legislation. Products should only be used in appliances and manners complying with the law.

Jurisdiction

All legal disputes related to card processing are handled under the United Kingdom Law.
